Quality and complaints procedure

QUALITY AND COMPLAINT PROCEDURE

World Health Organization and the law

The Dutch Professional Association of Lactation Experts (NVL), the WHO and the law set requirements for the quality of actions of lactation experts.

WHO-code

The WHO code is in full called the "International Code of Conduct for Placing on the Market of Breast Milk Replacements." It means that parents must be able to make a choice for their child's diet, without influencing commercial parties. Thanks to the WHO code, advertising for baby food in the Netherlands has been curbed within six months. The WHO code is more extensive than the Dutch Commodities Act or the European laws and regulations. I hold / my company adheres to the WHO code in the most comprehensive form.

I wholeheartedly endorse the WHO code. That's why I only work with brands and products from companies that also adhere to the WHO code. This is the reason why I will not advertise for some brands.

The WHO code wants:
• protect and promote breastfeeding
• that parents receive the correct and sufficient information
• that breast milk substitutes - when necessary - are used correctly
• that guidelines for the sale and advertising of baby food are adhered to

The WHO code can be read in Dutch.

Privacy and AVG

As a client it is good to know how the lactation consultant IBCLC handles personal data. The IBCLC lactation expert must be able to demonstrate that a processing complies with the most important principles of processing. Such as legality, transparency, goal keeping and correctness (accountability)

Privacy

The General Data Protection Regulation (GDPR) has been applicable since 25 May 2018. This means that from that date the same privacy legislation applies throughout the European Union (EU). In addition to this general law, specific rules apply to privacy in healthcare. These rules are mentioned in, among other things, the Medical Treatment Agreement Act (WGBO).

Professional secrecy

Data is not provided to third parties without permission, not even to close relatives. Client must give permission for this. Due to the nature of her / his duties, the lactation consultant IBCLC has to adhere to the Medical Professional Secrecy Act. In the Code of Personal Conduct of the IBLCE, professional secrecy is specifically mentioned and lactation experts IBCLC are obliged to adhere to it. If the IBCLC lactation expert feels called upon to release himself from professional secrecy, she / he will first examine whether informing other care providers could resolve the reason for canceling professional secrecy. In extreme situations, the lactation consultant IBCLC may consider turning to a judicial institution.

Processing of personal data

Personal data is all data that can be traced to a person. The lactation consultant IBCLC should request permission to process data and needs it for the implementation of the agreement. It may only request data that are necessary for proper supervision. The data must be appropriately secured. With this, it complies with the principles for processing personal data. A lactation consultant with a private practice does not have a data protection officer.
